EU AI Act Penalties: What Happens If You Don't Comply?

The Three Penalty Tiers

What Triggers Each Penalty Tier
Tier 1: Prohibited Practices (EUR 35M / 7%)
These are the most serious violations. Since February 2, 2025, the following AI practices are already banned:
- Social scoring by governments
- Manipulation techniques that cause harm
- Exploitation of vulnerable groups
- Untargeted facial recognition scraping for database building
- Emotion recognition in workplaces and schools (with limited exceptions)
- Biometric categorization based on sensitive characteristics
- Predictive policing based solely on profiling
Enforcement on prohibited practices is already active. Organizations still operating these systems are at immediate risk.
Tier 2: High-Risk Non-Compliance (EUR 15M / 3%)
From August 2, 2026, this covers failures in:
- Risk management systems (Article 9)
- Data governance and training data quality (Article 10)
- Technical documentation (Article 11)
- Record-keeping and logging (Article 12)
- Transparency and information to deployers (Article 13)
- Human oversight provisions (Article 14)
- Accuracy, robustness, and cybersecurity (Article 15)
- Quality management systems
- Conformity assessment procedures
- Post-market monitoring

Tier 3: Incorrect Information (EUR 7.5M / 1%)
Providing false or misleading information to national competent authorities or notified bodies. This includes incorrect declarations of conformity, fraudulent documentation, or withholding information during audits.

Who Enforces the AI Act?
Enforcement follows a two-level structure:
- National level: Each EU member state must designate a national competent authority and a market surveillance authority by August 2, 2025. These bodies handle complaints, audits, and enforcement within their jurisdiction.
- EU level: The European AI Office (established within the European Commission) oversees GPAI model compliance and coordinates cross-border enforcement.
Not all member states have designated their authorities yet, but enforcement infrastructure is being built in parallel with compliance deadlines.
What Regulators Will Look For
Based on GDPR enforcement patterns and the AI Act's own provisions, expect regulators to prioritize:
- Documentation gaps are the easiest to identify and prove. If your technical documentation doesn't exist, there's no argument to make.
- Lack of risk classification shows you haven't even started. If you can't demonstrate you've assessed whether your AI systems are high-risk, regulators will assume the worst.
- No quality management system indicates systemic non-compliance, not just an oversight.
- Complaints from affected individuals. Like GDPR, many investigations will be triggered by people who feel an AI system treated them unfairly.
- High-profile incidents. A biased hiring algorithm or a dangerous autonomous system making news will bring regulators quickly.
Practical Steps to Reduce Risk
- Start with an AI inventory. You can't manage what you don't know about. Catalog every AI system in your organization.
- Classify risk levels. Determine which systems fall under high-risk categories (Annex III).
- Prioritize documentation. Technical documentation under Article 11 and Annex IV is the most tangible compliance deliverable.
- Establish a QMS. A quality management system is required for all high-risk AI providers.
- Consider compliance tooling. AI Act compliance tools can accelerate documentation, risk assessment, and ongoing monitoring.
- Don't wait for enforcement actions. Building compliance infrastructure takes 12-18 months. With 4 months to the deadline, starting today is already late.
